This program will include an overview of the current state of the cannabis industry in Michigan, how the industry has changed in the past year and the outlook for the next 12 months as the industry continues to evolve.  Entering the third year since legalization, the companies that grow, produce and sell marijuana are making some significant changes to their business strategies which will be explored.  The industry has gotten increasingly competitive, with hundreds of brands competing for attention. At the same time, relatively few cities in Michigan have opted to allow marijuana sales within their borders.

Other challenges include: There were 80 unique cannabis brands that made a sale in Michigan’s cannabis market in 2019, the first year the cannabis market intelligence firm Headset started tracking this data in the state. In 2020, that increased to 512 brands; in 2021, that number rose further to 775. So far this year, 766 unique brands have made a sale.  Meanwhile, the average retail price for an ounce of recreational marijuana flower dropped to $116.84 in August, the most recent data from Michigan's Cannabis Regulatory Agency shows, down from $222.42 the same month a year ago.

Included will be the legal and regulatory landscape and challenges for various players in the industry.  There will be time for questions & answers at the end of the program.

 Benjamin Sobczak is an experienced litigator with an emphasis on shareholder and close corporate disputes, collection actions, private securities litigation, class action defense, and business torts. He also serves as outside general counsel providing regulatory and transactional-based services to cannabis companies in various jurisdictions throughout the U.S. and Canada. He is a frequent speaker at professional seminars and conferences and is recognized as a leading legal contributor to the Michigan cannabis industry. Prior to joining Dickinson Wright, Ben served as the Chief Legal Officer for a vertically integrated cannabis company with operations in Michigan and Massachusetts. In that role, Ben gained invaluable experience as a business operator and entrepreneur. That expanded perspective enables him to fully appreciate client needs and develop practical and cost-effective legal solutions in furtherance of their success.  

 Myles J. Baker practices in the areas of regulatory cannabis, complex business litigation, and labor and employment litigation. Myles received his undergraduate degree from Michigan State University and his law degree from Michigan State University College of Law. Myles began his career with Dickinson Wright PLLC by joining the firm as a Summer Associate in back-to-back years during 2015 and 2016. Myles’ ultimate goal is to utilize his wide range of skills and knowledge to provide effective legal counsel and achieve the best possible outcome for his clients.
